This bill would direct the Food and Drug Administration and the Department of Health and Human Services to take stronger steps to block counterfeit, unapproved, misbranded, or adulterated drugs and drug ingredients from entering the United States, with a particular focus on products from China and other countries the Secretary of State designates as adversarial.
What the bill would do
- Require federal agencies to use existing drug-law authorities to stop the import of questionable drugs, including active pharmaceutical ingredients and “key starting materials” used to make drugs.
- Increase enforcement against foreign manufacturers, importers, and other entities involved in the drug supply chain if they are handling unlawful drug products.
- Allow the government to refuse entry to covered products and, in some cases, order destruction of refused goods that pose significant public health concerns, without allowing them to be exported first.
- Expand the list of circumstances under which a foreign drug establishment can be barred from registration if it knowingly used forced labor or violated U.S. sanctions.
- Add new prohibited acts and labeling/misbranding rules for false or fraudulent statements tied to imported drugs.
More reporting and transparency
The bill would require drug manufacturers and other registrants to report more detailed supply-chain information, and to do so quarterly instead of annually. The new reporting would cover, for certain drugs, the identity, quantity, and country of origin of active ingredients, key starting materials, and certain intermediate materials.
For the first year after the new rules take effect, this added reporting would apply to drugs on the FDA’s Essential Medicines List that rely on ingredients or materials sourced from China or another foreign country of concern. After that first year, the reporting would apply more broadly to drugs with ingredients or materials sourced from China or another foreign country of concern.
Companies would have to keep supporting records for at least five years and make them available to the Secretary upon request.
New reports to Congress
- The Secretary of Health and Human Services would have to send annual reports to Congress on enforcement actions taken against unlawful imports.
- The Secretary would also have to submit a confidential report analyzing U.S. dependence on pharmaceutical ingredients and starting materials from China and other foreign countries of concern, identifying supply-chain vulnerabilities and trends over time.
- Within 180 days of enactment, HHS would have to report on current legal tools that could encourage sourcing from other countries, and on gaps in existing authority.
New regulations and guidance
- HHS would have to issue proposed regulations within 90 days and finalize them later under set deadlines.
- HHS would also have to issue guidance defining the term “key starting material,” since that term is used throughout the bill.

- cancel, limit, or terminate an insurer’s policies solely because the insurer works with legal cannabis businesses;
- pressure insurers to avoid covering cannabis businesses, or downgrade/cancel coverage, just because the policyholder is a cannabis business owner, employee, or operator;
- take adverse supervisory action against an insurer solely because it covers, insures, or leases property or equipment to a cannabis-related legitimate business.
Federal legal protection
The bill would also say that, in states, localities, or tribal lands where cannabis activity is allowed by law, insurers and their officers, directors, and employees could not be held liable under federal law or regulation solely for:
- providing insurance services connected to legal cannabis businesses; or
- reinvesting income earned from that insurance business.

This bill would sharply limit how U.S. intelligence authorities can use certain surveillance powers against U.S. persons (generally, U.S. citizens and some other people with legal ties to the United States).
What it changes under the Foreign Intelligence Surveillance Act (FISA)
The bill would add a new section to FISA saying the government could not use FISA authorities to:
- conduct electronic surveillance of a U.S. person;
- carry out a physical search of property used exclusively by, or under the open and exclusive control of, a U.S. person;
- get approval for a pen register or trap-and-trace device to collect information about a U.S. person;
- compel production of tangible things, such as books, records, papers, or documents, concerning a U.S. person; or
- target a U.S. person for acquisition of information.
It would also bar officers from querying data collected under Section 702 of FISA using search terms tied to a U.S. person.
Limits on using intelligence-derived information
The bill would generally prohibit the government from using information about a U.S. person that was acquired or derived from FISA collection as evidence against that person in criminal, civil, or administrative proceedings, or as part of an investigation.
There is an exception: the person whose information was collected, if they are a U.S. person and an “aggrieved person” under the bill, could use that information in their own defense or in their own proceeding or investigation.
Changes affecting surveillance under Executive Order 12333
The bill would also restrict surveillance conducted under Executive Order 12333, or any successor order. In practical terms, it would:
- treat certain searches or acquisitions of U.S. persons as needing to happen only through the normal legal authorities already available for physical searches, communications content, non-content information, or business records;
- bar the government from using information about a U.S. person obtained or derived from EO 12333 surveillance as evidence against that person in legal proceedings or investigations;
- prohibit government entities or officers from querying communications content, non-content information, or business records of a U.S. person under EO 12333; and
- allow the U.S. person whose information was collected to use that information in their own case.
Effect on existing Fourth Amendment law
The bill says it should not be read to change existing Supreme Court law about exceptions to the Fourth Amendment warrant requirement, including exigent circumstances.

- Comparable interests held through derivatives or similar financial instruments
It would not treat these as covered interests if they are:

What judges would have to do

Each judge would have to file a written attestation within 15 days after establishing the trust, confirming either:
- that the trust has been established and the covered assets were placed into it, or
- that the judge and covered family members do not have any covered financial interests
The Administrative Office of the U.S. Courts would have to post these attestations in the existing searchable online database used for certain judicial disclosures.

What changes for widows, widowers, and surviving divorced spouses with disabilities
Under current law, some disabled surviving spouses or surviving divorced spouses can only qualify for unreduced survivor benefits at certain ages. This bill would remove those age limits, so a disabled widow, widower, or surviving divorced spouse could qualify for survivor benefits at any age, if they meet the other requirements.
It would also remove a current rule that reduces certain survivor benefits when they are claimed before retirement age. In other words, some people who qualify under the new disability rules would no longer have their survivor benefit cut just because they claimed it before full retirement age.
The bill also changes how remarriage affects eligibility in these cases. If a widow, widower, or surviving divorced spouse remarries after the first month they become eligible for the benefit, that remarriage would be treated as though it had not happened for purposes of receiving the benefit.
These changes would generally take effect on January 1, 2027.
Changes to child-in-care benefits
The bill would raise the age limit for “child-in-care” Social Security benefits. These are benefits paid to a parent or caregiver who is looking after a child and qualifies under Social Security rules. The child age limit would increase from 16 to 18, or to 19 if the child is a full-time elementary or secondary school student.
This change would also take effect on January 1, 2027.
Higher survivor benefit amounts in some cases
The bill would also change the formula for how much some widow(er) survivor benefits can be paid. For certain people whose deceased spouse had claimed retirement benefits early and therefore received a reduced retirement benefit, the survivor benefit could be adjusted upward in some circumstances.
In addition, the bill creates new “delayed receipt” increases for survivor benefits. In general, if a widow or widower was eligible for a survivor benefit but did not claim it right away, the eventual monthly benefit could be increased to reflect the months they delayed filing or postponed payment. The bill sets out rules for how those increases are calculated and places caps on them so they do not exceed certain maximum amounts tied to the deceased worker’s own benefit.
These survivor-benefit changes would also generally start on January 1, 2027.
Other benefit coordination rules
The bill would require that some additional income from the higher Social Security benefits be ignored when determining eligibility for other federal, state, or locally funded benefit programs. This means that, for people already receiving certain assistance, the Social Security increase would not automatically reduce or eliminate their other benefits because of income rules.
If a person later stops qualifying for the other program, the protection would no longer apply.
Information for surviving spouses
The bill would direct the Social Security Administration to publish a booklet by January 1, 2027 explaining survivor benefits. The booklet would cover:
- how retirement benefits and survivor benefits interact,
- how and when to claim benefits,
- how claiming at different times can affect payment amounts,
- the lump-sum death benefit, and
- how to contact Social Security for more information.
For people who die on or after January 1, 2027, the Social Security Administration would have to mail this booklet to known widows, widowers, or surviving divorced spouses within 30 days after being informed of the death.
