This bill would create federal rules for electric utilities when serving large-load customers , which are defined as non-residential customers at a single site or campus with a peak electric demand of 100 megawatts or more . In plain terms, this mainly affects very large power users such as major data centers, large industrial facilities, or similar operations.

What the bill requires utilities to do

The bill says electric utilities must structure rates and agreements so that a large-load customer pays the full, incremental cost of any new or upgraded generation, transmission, or distribution equipment needed to serve that customer. This includes situations where the customer later stops buying power from that utility.

Before a utility makes an upgrade needed for a large-load customer, it must either:

  • require that customer, or group of customers, to cover the full cost through a contribution in aid of construction; or
  • assign the full cost to a class of large-load customers.

State action requirements

The bill would require state utility regulators, and nonregulated utilities, to begin considering this federal standard within 1 year after enactment, and to finish their consideration within 2 years after enactment.

If a state had already implemented the standard, or if the state legislature had already voted on implementing it, these new federal review requirements would not apply in the same way.

Highway funding penalty for noncompliance

The bill would also tie this issue to federal highway money. If a state does not implement the required standard, the Secretary of Transportation would withhold 100% of certain federal highway funds that would otherwise be apportioned to that state, beginning with the first fiscal year after the first fiscal year following enactment.

Practical effect

The main effect would be to shift more of the cost of building or upgrading electric infrastructure onto very large electricity users rather than spreading those costs across broader groups of ratepayers. States would also face pressure to adopt the standard because of the risk of losing highway funds.
