Representative Steve Cohen introduces H.R. 10517: Fair Fees Act

None

We have received text from H.R. 10517: Fair Fees Act. This bill was received on 2026-09-21, and currently has no cosponsors.

Here is a short summary of the bill:

This bill would require airlines, foreign airlines flying to or from the United States, and certain ticket sellers to provide cash refunds in a wider set of situations involving flights that are cancelled, significantly delayed, or significantly changed.

Refunds for airline-caused cancellations, delays, or changes

If a passenger has a ticket for a flight to, from, or within the United States, and the airline cancels the flight or the flight is significantly delayed or changed, the airline would have to give a full cash refund if the passenger does not want to:

  • take the delayed or changed flight,
  • accept a rebooking on another flight, or
  • accept a voucher, credit, or other compensation.

The refund would include the fare, taxes, and ancillary fees collected by the carrier.

The bill defines a “significantly delayed or changed” flight to include at least:

  • a domestic flight arriving 3 or more hours late, or
  • an international flight arriving 6 or more hours late.

How quickly refunds must be paid

If the ticket was bought with a credit card, the refund would have to be issued within 7 business days after the refund request is considered made. If the ticket was bought with cash or another payment method, the refund would have to be issued within 20 days .

The bill also says a passenger is treated as having requested a refund in certain cases, such as when:

  • the flight is cancelled and no alternative flight or compensation is offered,
  • the passenger rejects the delayed/changed flight, a rebooking, or compensation, or
  • the passenger does not respond by the time the cancelled or delayed flight was supposed to depart.

Ticket agents

Within 1 year, the Department of Transportation would have to issue a rule applying these refund requirements, and related notice rules, to ticket agents as well. If a ticket agent is responsible for giving the refund but does not have the passenger’s money, the airline would have to transfer the funds promptly.

Passenger-initiated cancellations

The bill would also require covered carriers and ticket agents to offer a full cash refund when a passenger cancels a ticket at least 48 hours before departure . That refund would have to include taxes and ancillary fees, and it would have to be paid within 30 days of the cancellation.

Before selling the ticket, the carrier or ticket agent would have to tell the passenger in writing that this cancellation right exists.

Vouchers and credits

Airlines could still offer vouchers, credits, or other compensation instead of a refund, but only if the offer clearly explains:

  • the terms of the offer, and
  • the passenger’s right to رفض it and choose a cash refund instead.

Any voucher or credit offered as an alternative would have to be usable without an expiration date or use-by deadline .

Who is covered

The bill would apply to:

  • large passenger airlines with more than $1.5 billion in annual operating revenue,
  • all foreign passenger airlines operating flights to or from the United States, and
  • ticket agents, once the relevant rules are issued.

Starting in 2028, the $1.5 billion revenue threshold would rise with inflation each year.

Penalties

Violations of these requirements could lead to civil penalties under existing federal aviation law.
