- Were excluded from participating in federal health care programs by the Department of Health and Human Services Inspector General; or
- Were determined by the VA Secretary to have knowingly taken part in a scheme to improperly obtain, keep, divert, misuse, or conceal federal funds, benefits, grants, contracts, reimbursements, or other federal assistance.
Who it applies to
The bill covers two groups of VA workers:
- Employees in certain VA health care positions listed in existing law;
- Additional employees hired under a separate VA hiring authority.
Process for certain VA determinations
If the VA Secretary makes the fraud-related determination described above, the person affected would have to be given:
- Advance notice of the determination;
- A file containing the evidence used to make it; and
- An internal grievance process to challenge the decision.
If the person uses that grievance process, they could be represented by a lawyer or another chosen representative. The Assistant Secretary for Accountability and Whistleblower Protection would decide the grievance, and that decision would be final.
Practical effect
In plain terms, the bill is meant to prevent the VA from hiring or keeping workers who have been found to have knowingly committed fraud or related misconduct involving federal funds. It also sets up a review process for people who are disqualified based on a VA determination rather than a court conviction or formal exclusion.
