S. 5392: Training and Education for American Members in University Sports and Athletics Act

This bill would change the rules for colleges and universities that receive federal student aid funds under Title IV of the Higher Education Act.

What it would require

For each varsity sports team, a school would have to make sure that no more than 20% of the athletes on the official roster are “international student athletes.” For teams with fewer than 10 athletes, the limit would be one international athlete per team.

The school would also have to report each year to the U.S. Secretary of Education and to the relevant athletic association what percentage of each varsity team’s roster is made up of international student athletes.

Who counts as an international student athlete

Under the bill, this would include a student-athlete who is either:

• not a U.S. national and not a lawful permanent resident, or
• receiving, or having received, pay, a scholarship, or other athletic financial support from a foreign Olympic or Paralympic committee.

What counts as a varsity team and athletic association

The bill defines a varsity sports team as a team organized by the school for intercollegiate competition. It defines an athletic association as a multi-state organization that sets rules or standards for varsity sports or college athletic competitions, but not an entity tied to professional sports leagues.

When it would take effect

The change would start on July 1, 2029, and would apply beginning with the 2029–2030 academic year.
