H.R. 9547: Veterans and Servicemembers PTSD Emerging Treatment Review Act of 2026

This bill would require the Department of Defense to study and report on an existing 2026 clinical trial involving whole-mushroom psilocybin for treatment-resistant post-traumatic stress disorder (PTSD).

What the bill does

• Directs the Assistant Secretary of Defense for Health Affairs to submit a report to Congress within 180 days after enactment.
• The report must examine the operational relevance, safety, dosing, and feasibility of the clinical trial data as they apply to:
  • active-duty servicemembers,
  • reserve and National Guard members,
  • veterans, and
  • servicemembers transitioning to civilian life.
• The report must include:
  • a summary of safety, dosing, and adverse-event data from the trial;
  • an analysis of how that data might apply to the military;
  • an assessment of possible effects on force health protection, medical readiness, and suicide prevention;
  • a description of legal and regulatory requirements for any expanded access pathway involving an investigational Schedule I substance;
  • an assessment of how federal “right to try” rules might apply;
  • considerations for continuity of care when patients move from military health care to the Veterans Health Administration, including eligibility, oversight, informed consent, safety monitoring, and adverse-event reporting; and
  • an estimate of the resources, staff, infrastructure, and timeline needed for any pilot program or expanded research starting in fiscal year 2027 or later.
• The report must be developed in coordination with the Defense Health Agency and in consultation with the Department of Veterans Affairs, Department of Health and Human Services, the FDA, and other agencies as needed.
• The report would be submitted in unclassified form, though it could include a classified annex if needed.

What it does not do

• It does not authorize psilocybin treatment for service members or veterans by itself.
• It does not create a new treatment program directly.
• It mainly requires review, analysis, and reporting to Congress.
