H.R. 9502: Protect Seniors and Veterans from Health Care Fraud Act of 2026

This bill would require the Department of Veterans Affairs (VA) to try to make an agreement with the Department of Health and Human Services (HHS) within one year. The goal is to help stop duplicate, improper, or mistaken billing and payments when veterans receive hospital care or medical services through the VA and are also enrolled in:

• Medicare
• Medicaid
• a Medicare Advantage plan

What data sharing would be set up

The agreement would allow the VA and HHS/Centers for Medicare and Medicaid Services (CMS) to share certain information about veterans who are in the VA patient enrollment system and are also covered by one of those other programs.

Under the bill, the VA would send HHS information about veterans receiving VA care, including billing codes and diagnosis codes if the VA thinks they are appropriate. HHS would use that information to identify veterans who are enrolled in both systems and then send VA a list of those veterans, along with any other information HHS thinks is appropriate.

How long it would last

The required agreement would last for two years starting when the VA enters into it.

Reporting requirement

The VA would have to report to the House and Senate Veterans’ Affairs Committees:

• within one year after the agreement is entered into, and
• every two years after that while the agreement is in effect.

The report would need to explain what the VA has done under the agreement and evaluate whether it is helping reduce duplicate, improper, or erroneous billing or payments.

Practical effect

In simple terms, the bill is designed to help the VA and Medicare/Medicaid systems cross-check records so they do not both pay for the same care by mistake, or bill in ways that conflict with each other.
