H.R. 10232: To prohibit the transfer of certain offices and functions of the Department of Education to other Federal agencies, and for other purposes.

This bill would limit the Department of Education’s ability to move certain responsibilities to other federal agencies. In plain terms, it says the Secretary of Education could not shift, outsource, or reassign the work of several major Education Department offices to another agency, except in a few narrow cases.

What offices are covered

The restriction would apply to these Education Department offices:

• Office of Special Education and Rehabilitative Services
• Office of Postsecondary Education
• Office of Indian Education
• Office of Elementary and Secondary Education

What the bill would prohibit

The bill would bar the Department of Education from making new agreements with other federal agencies, or using certain existing legal authorities, to do things like:

• run or administer programs handled by those offices
• make grant awards
• provide technical assistance
• collect or share data tied to program enforcement
• monitor grantees
• carry out oversight or administrative duties related to programs funded through the Department
• transfer money, staff, equipment, or facilities to another federal agency for those functions

It would also prevent the Department from moving a function or program out of one of those offices to another office within the Department and then using another federal agency to carry out that function.

Exceptions

The bill would not affect interagency agreements or contracts that were already in place on February 1, 2025. It would also allow those same arrangements to be renewed, as long as the renewed version keeps the same or substantially similar terms.

Reporting and cost disclosure

For any interagency agreement entered into on or after February 1, 2025, the Secretary of Education would have to submit a detailed cost report within two weeks of enactment and then every quarter after that. The report would go to certain House and Senate committees and also be posted publicly on the Department’s website.

Those reports would need to break down the actual and estimated costs of items such as:

• grant administration
• training for staff and grantees
• moving or onboarding Department staff
• facility changes
• technology and infrastructure changes
• overhead and administrative costs
• contract cost changes
• reductions in force of Department staff

Travel funds restriction

The bill would also block the Department from using certain fiscal year 2026 and 2027 funds for the Education Secretary’s travel expenses unless the required cost information is provided.
