What counts as a “sanctuary jurisdiction”

The bill defines a sanctuary jurisdiction as a state or local government that has a law, ordinance, policy, or practice that does either of the following:

Restricts government officials from sharing, receiving, keeping, or exchanging information about a person’s citizenship or immigration status with federal, state, or local governments; or
Refuses to comply with certain lawful requests from the Department of Homeland Security, such as immigration detainers or requests to notify DHS when someone is being released.

How the funding restriction would work

HUD grant funds could not be used in a sanctuary jurisdiction if the bill becomes law. The restriction would apply only to grant funds distributed on or after 180 days after enactment, so there would be a six-month delay before the new rule takes effect.

Who would decide

The bill says the HUD Secretary would consult with the Secretary of Homeland Security to determine which jurisdictions meet the definition of a sanctuary jurisdiction.

Practical effect

In practice, the bill would tie certain federal housing-related grant funding to local or state immigration-related policies. Jurisdictions that limit cooperation or information-sharing on immigration status, or that do not comply with certain DHS detainer or release-notification requests, could lose eligibility for HUD grants used within their borders.
