H.R. 10124: Mail Theft and Postal Key Crime Prevention Act of 2026

This bill would create a more organized federal response to mail theft and related fraud. In plain terms, it would:

• Set up a dedicated prosecutor in each federal judicial district called a Mail Theft Coordinator. The Attorney General would choose an assistant U.S. attorney for this role in consultation with the local U.S. attorney.
• Give that coordinator responsibility for helping oversee investigations and prosecutions involving:
  • theft or unlawful possession of postal keys or locks;
  • theft or receipt of stolen mail;
  • organized schemes using stolen mail to commit identity theft, check fraud, bank fraud, or access device fraud;
  • related conspiracy or fraud offenses tied to those crimes.
• Require coordination among the Postal Inspection Service, the FBI, Homeland Security, Treasury, state and local law enforcement, and other relevant federal agencies.
• Require the Attorney General to report to Congress within one year and then once a year for five years on:
  • trends in mail theft;
  • how many cases are being prosecuted under key federal laws;
  • how agencies are working together;
  • trends in theft or trafficking of postal keys, arrow keys, and counterfeit postal access devices;
  • recommendations for better prevention and prosecution.
• Direct the U.S. Sentencing Commission to review and update federal sentencing guidelines so they better account for mail theft offenses, especially where there is:
  • theft or trafficking of postal keys or counterfeit postal access devices;
  • organized or large-scale mail theft;
  • identity theft, check fraud, bank fraud, or access device fraud using stolen mail;
  • violence, threats, or robbery against postal workers or contractors;
  • mail theft affecting many victims or causing major financial losses.

The bill also says it should not be read as limiting any existing authority that the Justice Department, the Postal Inspection Service, or other federal law enforcement agencies already have.
