H.R. 10041: Smart Data Center Policy Act

This bill would direct the Secretary of Commerce to study the effects of building data centers within or near certain types of locations in the United States. Those locations are:

• military installations
• rail hubs
• airports
• air cargo facilities
• air traffic control facilities
• industrial zones

What the study would look at

The study would examine:

• the cost of building new data centers in or near these locations
• how placing data centers there might affect the electric grid, the environment, and water systems
• which of these locations have enough land, water infrastructure, and energy capacity to support new data centers
• possible federal incentives that could encourage data centers to be located in or near these areas

Reporting requirement

The Secretary of Commerce would have to submit a report with the study’s findings within 180 days after the bill becomes law. The report would go to relevant committees in both the House and Senate.

What the bill does not do

The bill does not itself require any data centers to be built, restrict where they can be built, or create any new subsidies or regulations. It only orders a study and a report to Congress.
