Effect on immigration cases

The bill also creates a process for people in immigration removal proceedings to challenge DHS conduct in federal district court.

• If the court finds DHS violated the bill’s anti-profiling rules, the judge would have to dismiss the removal proceedings against that person.
• If the court finds no violation, the case would be sent back to immigration court and the removal case would continue.
