This bill would direct the Consumer Product Safety Commission (CPSC) to treat certain gases used in compressed air dusters as hazardous substances. In practical terms, it is aimed at reducing the misuse of these products for getting high.

What products are covered

The bill defines an aerosol duster product as a pressurized canister that uses gas or liquefied gas to blow dust and debris away. These are commonly sold as computer or electronics dusters.

The bill focuses on products containing certain propellants, specifically:

  • 1,1-difluoroethane (HFC-152a)
  • 1,1,1,2-tetrafluoroethane (HFC-134a)
  • Products made from those substances

What the CPSC would have to do

The bill would require the CPSC to classify those substances as hazardous under federal law. It would also make aerosol duster products, and other aerosol products, into banned hazardous substances if they contain more than 18 milligrams of the covered hazardous substances.

The CPSC would also be required to make sure manufacturers do not stockpile banned products by making or importing them at more than 105% of their normal baseline level during the 13 months before the bill becomes law.

Possible future expansion

The bill would give the CPSC authority to add more propellants by regulation if it determines they are being used for recreational inhalation and should be treated as hazardous substances.

What would not be affected

The bill says it would not apply to drugs regulated by the Food and Drug Administration.
