We have received text from H.R. 8116: Shared Home Appreciation for Residential Equity Act. This bill was received on 2026-03-26, and currently has 2 cosponsors.

Here is a short summary of the bill:

The Shared Home Appreciation for Residential Equity Act, known as the SHARE Act, proposes changes to tax laws regarding shared appreciation mortgage contracts. Here’s a breakdown of the key points:

Definition of Shared Appreciation Mortgage

A shared appreciation mortgage is defined as:

  • A mortgage secured by a second lien on a residential property designed for one to four families.
  • A mortgage that allows the lender to receive a predetermined percentage of the property’s increase in value.
  • One where the mortgagor (the borrower) only needs to make a payment as specified in the mortgage terms.
  • The mortgage amount does not exceed 49% of the property's purchase price.
  • It must be subordinate to a first lien that is classified as a 'qualified mortgage' under federal law.
  • The repayment of the mortgage is deferred until specific conditions are met, such as the maturity of the first mortgage, sale of the property, or full repayment of the first mortgage.

Tax Exclusions Proposed

The bill specifies that certain amounts related to shared appreciation mortgages could be excluded from gross income, specifically:

  • Any repayment amount that exceeds the original principal of the shared appreciation mortgage, provided that:
    • The borrower's income does not exceed 140% of the area median income for the location of the property at the time the loan was issued.
    • The property in question is the borrower's principal residence.
  • Any gain from the sale of a capital asset linked to these mortgage contracts.

Eligibility and Effective Date

The provisions of this law will apply to amounts received after December 31, 2025.

Clerical Amendment
