H.R. 1049 - TRACE Act Summary

The bill, known as the Transparency in Reporting of Adversarial Contributions to Education Act (TRACE Act), aims to enhance parental awareness regarding foreign influence in public schools. Here is a breakdown of what the bill proposes:

Parental Rights to Information

Under the TRACE Act, local educational agencies must ensure that each elementary and secondary school provides parents with specific rights concerning foreign influence. This includes:

  • Review of Materials: Parents are entitled to review and make copies of curricular or professional development materials used at their child's school that were purchased or obtained with funds from foreign governments or entities. This access must be granted every four weeks and within 30 days of a parent’s request.
  • Compensation Disclosure: Schools must inform parents, within 30 days of a request, about the number of personnel whose salaries are partly funded by foreign entities.
  • Transparency on Donations and Agreements: Schools must disclose any donations received from foreign entities, any written agreements with them, and any financial transactions, along with the name of the foreign country or entity and the amount of funds received.

Notifications and Summaries

At the start of each school year, schools are required to:

  • Post on their websites, or disseminate to the public, a summary notice of parents' rights regarding foreign influence, as outlined by the bill.
  • State educational agencies must inform local educational agencies of these requirements to ensure compliance.

Definitions

The bill defines key terms, including:

  • Foreign Country: Includes any foreign country or its possessions, excluding U.S. territories.
  • Foreign Entity of Concern: This term is defined in the Research and Development, Competition, and Innovation Act, encompassing specific foreign entities that may pose risks of adversarial influence.

Funding Requirements

To qualify for certain federal education funds, local educational agencies must comply with the transparency requirements stipulated in the TRACE Act.
