S. 5009: Minimum Experience Requirements for Intelligence Transition Act of 2026

This bill would change the rules for who can serve as the Director of National Intelligence (DNI) on an acting basis. Under current law, the DNI is required to have significant national security experience. This bill would make that same requirement apply not only to a permanent DNI, but also to anyone serving as acting DNI or otherwise performing the duties of that office.

In practical terms, if the DNI position becomes vacant or temporarily unavailable, the person stepping in would need to meet the same experience standards as a confirmed DNI. The bill is aimed at ensuring that temporary leadership of the intelligence community is handled by someone with the required background in national security.

The bill does not appear to change the DNI’s core powers, the structure of the intelligence community, or the duties of other agencies. It only amends the eligibility standard for acting service in that specific position.
