S. 4912: Building Up Farmland Frontiers for Ecological Resilience Act

This bill would change the rules for the federal Conservation Reserve Program (CRP), which pays landowners to take certain environmentally sensitive farmland out of crop production and put it into conservation uses.

What the bill does

The bill adds a new category of land that can qualify for CRP enrollment. Under the new rule, land may be eligible if:

• it is otherwise eligible for the program, and
• a Tribal, state, or local law, ordinance, or other regulation requires the landowner to use a resource-conserving or environmental protection practice.

In other words, if a local or state rule already requires a conservation or environmental protection measure on the land, that land could still be enrolled in CRP.

Limit on eligibility

The bill would not allow this new eligibility category if the conservation or environmental requirement was imposed through:

• an administrative order, or
• a court order.

The bill also makes related wording changes in the existing CRP law to fit this new category.

Practical effect

In plain terms, the bill would make it clearer that some farmland can still enter the federal conservation program even when local, state, or Tribal rules require conservation-related practices on that land. It would not change the basic structure of CRP, but it could expand the kinds of land that qualify for enrollment by removing uncertainty about lands subject to certain legal conservation requirements.
