Prohibition on Federal Funds

The bill states that no federal funds can be provided to any elementary or secondary school if that school:

  • Has partnerships with Chinese cultural or language institutes: This includes any collaborations with institutions funded, either directly or indirectly, by the Chinese government, such as known entities like the Confucius Institute.
  • Operates a Confucius Classroom: If a school has a learning center that is supported by the Chinese government, it will be ineligible for federal funds.
  • Receives other forms of support: This encompasses any teaching materials, personnel, funds, or resources from anyone acting on behalf of the Chinese government.

The restrictions on funding will take effect one year after the bill becomes law.

Waiver Process for Existing Contracts

Schools that currently have contracts with entities funded by the Chinese government will have the option to apply for a waiver. The waiver process includes the following:

  • Submission of Waiver Request: Schools must submit a request to the Secretary of Education, which includes the full text of the contract (translated into English if necessary) and a statement showing how the contract benefits the school's mission and students and supports U.S. security and economic vitality.

  • Definition of Contracts: Contracts eligible for waiver consideration are those that started before the bill's enactment and are active after the effective date while relating to the prohibitive conditions outlined above.

Notification to Schools

The Secretary of Education is required to inform all affected schools about these funding restrictions and provide guidance on how to comply within 90 days of the bill's enactment.
